Requirements
To participate in the US EB-5 Immigrant Investor Program, foreign nationals are required to invest in a new commercial enterprise that aligns with government-approved regional centers aimed at stimulating economic growth. The following conditions must be met:
- Choose one of the investment options:
- Invest USD 1,050,000 in a non-targeted employment area project.
- Invest USD 800,000 in a targeted employment area project located in a rural zone or an area with high unemployment.
- Ensure the creation or preservation of 10 permanent full-time jobs for qualified US workers.
Additionally, the applicant must demonstrate the legal source of their investment funds.
Once applicants successfully obtain their green card, the invested funds must remain in the project for a period of three to seven years, depending on the specifics of the project.
Approved applicants will initially be granted conditional green cards valid for two years. At the end of this period, the conditions will be removed if the applicant can provide evidence to US immigration authorities that the required jobs were indeed created or maintained. This shift from a conditional green card to a regular green card does not change the rights or privileges of the cardholder in the United States.
Procedure
Application Process:
- Applications must be submitted using the prescribed forms, along with the necessary fees and supporting documents.
- In addition to personal documentation, applicants need to provide medical reports, vaccination records, certified police clearance certificates, and any court records.
- The application for converting a conditional green card to a regular green card will take place two years after receiving the conditional card.
Family Members:
- Investors’ spouses and unmarried children under 21 may apply as derivative applicants, meaning they don’t need to make additional financial investments but must submit their own documentation.
Residency and Travel:
- Once approved, permanent residents can settle anywhere in the USA.
- However, their visa-free or visa-on-arrival access may be more limited than that of nationals from other countries.
Eligibility for Citizenship:
- To qualify for citizenship, green card holders must have lived continuously in the USA for at least five years before applying for naturalization.
- They must also have been physically present in the USA for a minimum of 30 months within the five years immediately prior to filing for naturalization.
- Applicants will need to demonstrate basic proficiency in reading, writing, and speaking English and pass a civics test. Other than these requirements, minimal additional conditions apply.
